Terms of Service

By accessing OmegaMind ("Platform", "Service", "we", "our"), operated by OmegaMind ("Controller"), you ("user") fully accept these Terms of Service ("Terms"). If you do not accept these Terms, you are not authorized to use the Platform. Continued use of the Service after publication of changes to the Terms constitutes acceptance of such changes.

OmegaMind is a digital platform dedicated to narrative, scientific and philosophical reflection, and the dissemination of content related to the evolution of civilizations. The Service includes, but is not limited to:

• Publication and consultation of chronicles, articles, and narrative content
• Interactive tools (Creative Forge, Synaptic Lab, Digital Twin Lab)
• Gamification and progression systems (Creative Mana, prestige titles, collectible cards)
• Community features (comments, voting, discussions)
• Newsletter and email-distributed content

To use the authenticated features of the Platform, you need to create an account. You declare that:

• You are at least 16 years of age (or the minimum age required by the legislation of your country)
• You will provide truthful, accurate, and up-to-date information
• You are responsible for the security of your account credentials
• You will immediately notify us of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms, without notice and without obligation of compensation.

All original content published on OmegaMind — including texts, graphics, logos, icons, AI-generated images, narrative structure, source code, and design — are the exclusive property of the Controller or their respective licensors and are protected by Italian, European, and international copyright and intellectual property laws.

Unless expressly authorized in writing, it is prohibited to:

• Copy, reproduce, distribute, or create derivative works from the Platform's content
• Use content for commercial purposes without a license
• Remove or alter copyright notices or attribution
• Systematically extract data from the Platform (scraping, mining)

By publishing content on the Platform (comments, drafts, proposals, votes), you grant OmegaMind a non-exclusive, free, worldwide, irrevocable, and sublicensable license to use, modify, adapt, publish, and distribute such content in the context of the Service and its promotion.

You declare and warrant that:

• You are the original author of the published content or hold the necessary rights
• Your content does not violate third-party rights, including intellectual property, privacy, and reputation
• Your content does not contain unlawful, defamatory, obscene, discriminatory, or otherwise illegal material

We reserve the right to remove any content that violates these Terms, at our sole discretion and without notice.

The Platform integrates generative artificial intelligence technologies for assisted content creation, analysis, and interaction. The user acknowledges and accepts that:

• AI-generated content is provided "as is" without warranties of accuracy, completeness, or fitness for specific purposes
• AI may produce inaccurate, inconsistent, or unverified results — it is the user's responsibility to verify the reliability of the content
• AI-generated content within the Platform may be used by OmegaMind to improve the Service
• The user must not use AI tools to generate illegal, harmful content or content that violates third-party rights

The user agrees not to:

• Use the Platform for illegal or unauthorized purposes
• Attempt to access unauthorized systems, data, or areas of the Platform
• Interfere with the operation of the Service (DDoS attacks, injection, exploits)
• Impersonate other users or entities
• Publish spam, unauthorized advertising, or malicious links
• Manipulate voting, gamification, or reputation systems
• Use unauthorized bots, scrapers, or automated tools
• Violate applicable laws, including data protection laws

The Platform includes gamification elements (Creative Mana, prestige titles, collectible cards, leaderboards). These elements:

• Have no real monetary value and cannot be converted into money
• May be modified, reset, or removed at the Controller's discretion
• Do not constitute an acquired right of the user
• May be revoked in case of violation of the Terms or misconduct

The Platform is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, the Controller shall not be liable for:

• Direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service
• Loss of data, profits, opportunities, or reputation
• Third-party content or external links on the Platform
• Interruptions, errors, viruses, or malfunctions of the Service
• Actions or omissions of other Platform users

In any case, the Controller's total liability to the user shall not exceed EUR 100 (one hundred euros).

The user agrees to indemnify, defend, and hold harmless the Controller, its collaborators, partners, and suppliers from any claim, damage, liability, cost, and expense (including reasonable legal fees) arising from:

• The user's violation of these Terms
• Content published by the user on the Platform
• The user's violation of third-party rights
• The user's improper use of the Service

We reserve the right to modify these Terms at any time. Changes will be effective from the date of publication on the Platform. Continued use of the Service after publication of changes constitutes acceptance of the new Terms. In case of substantial changes, notification will be provided through the Platform or via email.

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. In case of termination:

• The user's right to use the Service ceases immediately
• Provisions of these Terms that by their nature survive termination shall remain in effect (intellectual property, limitation of liability, indemnification, governing law)

The user may delete their account at any time by contacting legal@omegamind.io.

These Terms are governed by Italian law. For any dispute relating to the interpretation, execution, or termination of these Terms, the exclusive jurisdiction shall be the Court of the place of residence or domicile of the Controller, unless otherwise provided by mandatory consumer protection law.

Pursuant to EU Regulation No. 524/2013, for alternative online dispute resolution (ODR), access the European platform at: https://ec.europa.eu/consumers/odr

• Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain fully valid and effective.
• Waiver: Failure to exercise a right or power under these Terms does not constitute a waiver thereof.
• Assignment: The user may not assign their rights or obligations under these Terms without the written consent of the Controller.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between the user and the Controller regarding the use of the Service.
